Unfortunately, many children are injured each year while using and playing in playgrounds, whether while attending school or at other times. While it is true that some accidents and injuries involving children are no one’s fault, at times the injuries are due to defective or dangerous conditions in the playground.

If your child’s injuries were in fact caused by a defective or dangerous condition in the playground, then your child may be entitled to receive compensation for those injuries. Compensation would include past and future pain and suffering, as well as medical expenses and possibly other items of damages.

While the injuries children suffer while playing are usually fractures of the arms or legs, the injuries can also be more serious and even include head and brain injuries. With the understanding that children must be allowed to play, it is also important to reduce the risk of injuries while playing by providing a safe environment at the playground.

A safe environment at the playground includes properly maintained playground equipment, an environment that meets safety standards, and proper supervision.

There are many “Safety Standards” that are recognized and accepted and that set the minimum standards for safety in children’s playgrounds. These standards include the actual playground equipment, whether a swing, climbing ladders or monkey bars, just to name a few.

Safety standards also exist for the playground environment, such as what is the ground under the playground equipment covered in, is the ground hard or soft, are the benches or fences safe, and so forth.

If a child is injured while using a playground during school activities, then the school must provide proper supervision. Children of different ages, sexes and sizes must be monitored and supervised at all times, and even the games that children choose to play must constantly be monitored.

At the firm of Jaroslawicz & Jaros we have represented many children who suffered injuries while playing in playgrounds. We have represented children who were injured when falling off of equipment as a result of not being properly supervised; children who were hurt when older children were playing and wildly running around, causing the injury to the younger child; children who suffered cuts from a defective and dangerous fence; children who fell and landed on hard ground that was not properly covered; and many other fact patterns.

If your child was injured in a playground-related accident, call Jaroslawicz & Jaros at , toll free at 800-269-2780, submit an online questionnaire, OR you can reach partner Abraham Jaros on his cellphone, 917-842-9544, or at [email protected].

The initial consultation is free of charge, and if we agree to handle your case, we will work on a contingency fee basis, which means we get paid for our services only if there is a monetary recovery of funds. In many cases, a lawsuit must be filed before an applicable expiration date, known as a statute of limitations. Please call to ensure that you do not waive your right to possible compensation.
