When a subway ride proves dangerous

Many New Yorkers ride the subway nearly daily. According to the Metropolitan Transportation Authority’s most recent numbers, over 5.5 million people ride the subway on an average weekday. Delays and disturbances are often a part of the subway riding experience. Sometimes, a subway ride can prove much more serious.

Subway accidents happen

An article in the New York Post described a woman falling onto to the subway tracks in Brooklyn and then being run over by C train this last April. The paramedics carried her out on a stretcher and brought her to the nearby hospital.

Assessing liability

If you were seriously injured while riding public transit in New York City, you may be able to pursue a lawsuit against the Metropolitan Transportation Authority or the New York City Transportation Authority. These transportation service providers are obligated to provide safe transportation for riders. If they are found negligent in these duties, they could be liableto compensate you for your personal injuries.

Act quickly

After the accident, you must pursue a claim within 90 days. If you miss this deadline, you may not be able to file suit. Then the transportation authority conducts a hearing about the incident, and you can then move forward with your lawsuit. 

You should consider hiring an experienced attorney, who can assist you in doing so. Most attorneys work on a contingency basis, so they do not get paid unless they are successful in obtaining compensation on your behalf.
