Were You ‘Doored’ In A Bicycle Accident?

In a crowded urban area, “dooring” happens quite frequently. “Dooring” describes accidents in which bicyclists are hit and knocked off of their bikes by the opening of a car door parked on the side of the road. This type of bike accident happens so frequently that the area of the street 2 to 4 feet from car doors has been coined “the door zone.” There are actually laws regarding dooring in the New York Vehicle and Traffic Law.

According to Section 1214, no person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so and can be done without interfering with the movement of other traffic, nor shall any person leave a door open on the side of the vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers. What this means is that drivers can be held liable for injuries to bicyclists as a result of them opening their vehicle door.

Drivers should always check and see if the door zone is clear before stepping out. It is also against the law for a driver to leave a door open for an extended period of time while parked on the side of the road. Taxicab drivers are also required to stop parallel to the curb, within 1 foot, when picking up passengers. Picking up or dropping off passengers “should not obstruct the movement of traffic,” according to § 4-11.

It’s no secret that our city streets are riddled with potholes, manholes and other potential hazards. While these types of road defects may not be serious enough to damage a vehicle, they can definitely present a threat to bicyclists and other pedestrians. The best way to do this is by taking pictures, from a few different angles, of the manhole, street grating or pothole so you have some evidence to use in your injury claim.
